- If there is a will that was probated in a state other than Arkansas:
- Copy of the will
- Order, decree, or other document issued by an Arkansas court entering the will to probate in Arkansas, and
- If it is not clear on the face of the will who is to receive the property, then we will also require either an
- Order, decree, judgment, or other court document identifying the persons who get property under the will, or
- Affidavit of facts concerning the identity of devisees
- If there is a will that has not been probated:
- A copy of the will, and
- An affidavit that attests that all of the following information is true:
- The will was duly executed,
- The will was unrevoked by the testator prior to death,
- Court proceedings concerning the succession or administration of the estate have not occurred, and
- Either:
- The devisee or his successors and assigns possessed the property devised in accordance with the provisions of the will, or
- The property devised was not possessed or claimed by anyone by virtue of the decedent's title during the time period for testacy proceedings
- If there is a will that cannot be probated or does not dispose of the borrower’s real property, either:
- An order, decree, or other court document evidencing who gets the real property, or if one does not exist, then
- An order, decree, or other court document determining the heirs, or if one does not exist, then
- An affidavit proving that you are the borrower’s lawful heir under the Arkansas laws of intestate succession
