  • Court order, decree, or other document executed or certified by a court or Puerto Rican Notary indicating that you are entitled to an ownership interest in the deceased borrower’s real property secured by the mortgage loan

To prove your identity:

• Your photo identification, and
• Evidence that you are a relative of the borrower. Examples of acceptable documentation include a birth certificate, marriage license, death certificate, or affidavit

You have indicated that the borrower transferred all or a portion of his/her interest in the real property to you through a will. Please note that, in order to confirm you as a successor in interest to the borrower, we will require proof of the borrower’s death, proof that you were transferred an ownership interest in the borrower’s property, and proof of your identity.

To prove that you were transferred an ownership interest in the borrower’s property:

• If there is a deed transferring the real property to you:
  • Deed transferring the real property to you
• If there is a will that was probated in Puerto Rico:
  • Certified copy of the will as registered with the Registry of Wills of the Supreme Court of Puerto Rico and Accreditation Certification of Will issued by the General Registry of Notarial Competencies of the Office of Inspection of Notaries, which confirms that the will has not been revoked or modified, and
  • If it is not clear on the face of the will who is to receive the property, then we will also require either an
    • Declaration of heirship or other order or decree of court or Puerto Rican Notary determining the heirs of the borrower, or
    • Affidavit of facts concerning the identity of devisees
• If there is a will that was probated in a state or territory other than Puerto Rico:
  • Copy of the will
  • Order, decree, or other document issued by a Puerto Rican court or Notary validating the will, and
  • If it is not clear on the face of the will who is to receive the property, then we will also require either an
    • Declaration of heirship or other order or decree of court or Puerto Rican Notary determining the heirs of the borrower, or
    • Affidavit of facts concerning the identity of devisees
• If there is a will that cannot be probated or does not dispose of the borrower’s real property, either:
  • Declaration of heirship or other order or decree of court or Puerto Rican Notary determining the heirs of the borrower, or if one does not exist, then
  • An affidavit proving that you are the borrower’s lawful heir under the Puerto Rico laws of intestate succession

• Evidence that you are a relative of the borrower. Examples of acceptable documentation include a birth certificate, marriage license, death certificate, or affidavit
