Transfer Resulting from a Divorce or Separation - New York

Please note that, in order to confirm you as a successor in interest to the borrower, we will require proof that you were transferred an ownership interest in the borrower’s property and proof of your identity.
GIVEN YOUR CIRCUMSTANCES, WE WILL ACCEPT THE FOLLOWING DOCUMENTS:
To prove that there was a divorce or separation:
- Divorce decree or judgment; or
- Decree of legal separation
To prove that you were transferred an ownership interest in the borrower’s property:
- If the property was transferred through a deed:
- Deed transferring the property to you
- If a divorce decree or judgment affecting the property was issued by a court in a state other than New York:
- Deed transferring the property to you
- If you do not have a deed, but do have a divorce decree/judgment or decree of legal separation that determines the title to the real property, either:
- Recorded divorce decree/judgment; or
- Recorded decree of legal separation
- If you do not have a deed, but do have a divorce decree/judgment or decree of legal separation that incorporates an agreement that determines the title to the real property:
- Separation agreement, and either the:
- Recorded divorce decree/judgment; or
- Recorded decree of legal separation
- Separation agreement, and either the:
- If you have a divorce decree/judgment or decree of legal separation that orders the other party to deed or convey the real property to you:
- Deed transferring the property to you
To prove your identity:
- Your photo identification
