Please note that, in order to confirm you as a successor in interest to the borrower, we will require proof that you were transferred an ownership interest in the borrower’s property and proof of your identity.

GIVEN YOUR CIRCUMSTANCES, WE WILL ACCEPT THE FOLLOWING DOCUMENTS:

To prove that there was a divorce or separation:

• Divorce decree; or
• Decree of legal separation

To prove that you were transferred an ownership interest in the borrower’s property:

• If the property was transferred through a deed:
  • Deed transferring the property to you
• If a divorce decree or judgment affecting the property was issued by a court in a state other than North Dakota:
  • Deed transferring the property to you
• If you do not have a deed, but do have a divorce decree/judgment or decree of legal separation divests title from one party and vests it in another, either:
  • Divorce decree, or
  • Decree of legal separation
• If you do not have a deed, but do have a divorce decree/judgment or decree of legal separation that incorporates a stipulation agreement that divests title from one party and vests it in another:
  • Stipulation agreement, and either:
    • Divorce decree, or
    • Decree of legal separation
• If you do not currently have a deed, but do have a divorce decree/judgment or decree of legal separation that orders the conveyance of the real property to you:
  • Deed transferring the property to you
