Transfer Resulting from a Divorce or Separation - Utah

You have indicated that you acquired an ownership interest in the borrower’s property as the result of a divorce or separation. Please note that, in order to confirm you as a successor in interest to the borrower, we will require proof that you were transferred an ownership interest in the borrower’s property and proof of your identity.
GIVEN YOUR CIRCUMSTANCES, WE WILL ACCEPT THE FOLLOWING DOCUMENTS:
To prove that there was a divorce or separation:
- Divorce judgment; or
- Separate maintenance decree
To prove that you were transferred an ownership interest in the borrower’s property:
- If the property was transferred through a deed:
- Deed transferring the property to you
- If a divorce decree or judgment affecting the property was issued by a court in a state other than Utah:
- Deed transferring the property to you
- If you do not have a deed, but do have a divorce judgment or separate maintenance decree that includes specific language divesting the title of a party and vesting it in you:
- Divorce judgment, or
- Separate maintenance decree
- If you do not have a deed, but do have a divorce judgment that incorporates a property settlement agreement that includes specific language divesting the title of a party and vesting it in another:
- Property settlement agreement, and either:
- Divorce judgment, or
- Separate maintenance decree
- Property settlement agreement, and either:
- If you do not currently have a deed, but do have a divorce judgment that does not include specific language divesting the title of a party and vesting it in another:
- Deed transferring the property to you

- Your photo identification
