Transfer from a Borrower to the Borrower’s Spouse or Child - Louisiana

You have indicated that you acquired an ownership interest in the property through a transfer from a parent or spouse. Please note that, in order to confirm you as a successor in interest to the borrower, we will require proof that you were transferred an ownership interest in the borrower’s property and proof of your identity.
GIVEN YOUR CIRCUMSTANCES, WE WILL ACCEPT THE FOLLOWING DOCUMENTS:
To prove that you were transferred an ownership interest in the borrower’s property:
- If you were transferred the property by a deed or act of donation:
- Either:
- Deed conveying the property to you, or
- Act of donation conveying the property to you
- Evidence that the borrower is your parent or spouse
- Examples of acceptable documentation might include a birth certificate, marriage license, death certificate, or affidavit
- Either:
- If there is a deed titled to you and the borrower as community property:
- Deed titled to you and the borrower as community property
- If you acquired an interest in the property through Louisiana’s community property laws but the property is not titled as community property:
- Affidavit attesting that the property was community property, and that it was acquired while you and the borrower were married using marital funds
- If the property was transferred to an entity in which you have an ownership interest (e.g. limited liability company, limited partnership, etc.):
- Deed conveying the property to the entity, and
- Affidavit affirming that you have an ownership in the entity, and
- Evidence that the borrower is your parent or spouse
- Examples of acceptable documentation might include a birth certificate, marriage license, death certificate, or affidavit
