You have indicated that you acquired an ownership interest in the property through a transfer into an inter vivos trust. To confirm you as a successor in interest to the borrower, we will require proof of your interest in the property, proof of your identity, and proof that the borrower is, and remains, a beneficiary to the trust and that the transfer of the property into the trust does not relate to a transfer of rights of occupancy in the property.
GIVEN YOUR CIRCUMSTANCES, WE WILL ACCEPT THE FOLLOWING DOCUMENTS:
To prove that you were transferred an ownership interest in the borrower’s property:
- Deed or other instrument that conveys the property into the trust, and
- Either:
- Trust document and an affidavit signed or otherwise authenticated by the trustee that states:
- That the Trust document has not been revoked, modified, or amended in any manner
- Certification of trust signed or otherwise authenticated by the trustee that states:
- That the trust has not been revoked, modified, or amended in any manner that would cause the representations contained in the certification to be incorrect
- Trust document and an affidavit signed or otherwise authenticated by the trustee that states:
To prove your identity:
- Your photo identification
To prove that (i) the borrower is, and remains, a beneficiary to the trust, and (ii) the transfer into the trust does not relate to a transfer of rights of occupancy in the property, either:
- Affidavit signed or authenticated by the trustee, stating:
- The identities of all present beneficiaries
- That the borrower is, and remains, a beneficiary to the trust, and
- The transfer of the property into the trust does not relate to a transfer of rights of occupancy in the property
